Agreement to these terms
These Terms and Conditions govern your access to and use of the Bear Trail website and software products, including apps such as Murmur, Reef Keeper, Studio Ledger, Ritual Cafe, and Discord Desktop Fixer.
By using a Bear Trail product, you agree to these terms and our Privacy Policy. If you do not agree, do not use the product. If a specific product presents additional terms, those terms apply to that product or feature.
Using our products
You may use Bear Trail products for their intended purposes and in compliance with applicable law. You agree not to:
- interfere with, disrupt, or attempt to gain unauthorized access to a product or its supporting services;
- reverse engineer, copy, resell, or redistribute a product except where applicable law or its license expressly allows it;
- use a product to violate another person's rights, privacy, or security; or
- use a product to create or distribute malicious, unlawful, or harmful content.
You are responsible for keeping your device, accounts, and any access credentials secure.
Your content
You retain ownership of the information and content you create in a Bear Trail app. You give Bear Trail only the permissions needed to operate the feature you choose to use, such as storing, syncing, exporting, or displaying that content.
You are responsible for your content and for making sure you have the rights and permissions needed to enter or share it. Keep backups of anything important; local or exported data can be lost if a device, account, or storage location fails.
Our software and materials
Bear Trail and its licensors own the software, branding, designs, text, illustrations, and other materials we provide, excluding your content and third-party materials. We grant you a limited, personal, non-exclusive, non-transferable license to use the product while you follow these terms.
Bear Trail, the Bear Trail name and mark, and product names are not licensed for use in a way that suggests endorsement or partnership without our written permission.
Purchases and third-party platforms
If you obtain a Bear Trail app through an app store or another platform, that platform's purchase, subscription, refund, and account terms also apply. The platform processes payments and may provide support for transactions according to its own policies.
Bear Trail products may link to or work with third-party services. Those services are separate from Bear Trail, and their availability and terms are their responsibility.
Availability and disclaimers
We work to make our products useful and dependable, but products are provided on an “as available” basis. We do not promise that a product will always be available, error-free, compatible with every device, or suitable for every purpose.
Do not rely on a Bear Trail app as your only copy of information that is important, safety-critical, time-sensitive, or legally required. You are responsible for reviewing outputs and using your judgment.
To the maximum extent permitted by law, Bear Trail is not liable for indirect, incidental, special, consequential, or exemplary losses arising from your use of a product.
Changes and ending use
We may change, suspend, or discontinue a product or feature. We may also update these terms as our products change. If a change materially affects your use, we will make a reasonable effort to communicate it through the relevant product or website.
You may stop using a product at any time. We may suspend or end access if you materially breach these terms, create risk for others, or use a product unlawfully. Terms that should continue by their nature—such as ownership, disclaimers, and limits of liability—will continue.
Governing law
These terms are governed by the laws that apply where Bear Trail is established, without regard to conflict-of-law rules. Any dispute will be handled by the courts with appropriate jurisdiction, unless applicable law requires another forum.
